You can now apply for a 'no-fault' divorce. Since April 2022, the divorce and dissolution procedure in England and Wales has been simplified, aimed at reducing hostility between separating couples. You no longer need to cite your spouse or partner's conduct as grounds for divorce, and divorcing couples can make a joint application to terminate the marriage or civil partnership:
No-Fault Divorce Requirements
- Eligibility: For a 'no fault' divorce you must have been married for at least 12 months, the marriage must be recognised as such in the UK, the marriage must have irretrievably broken down, and one of you must still reside in the UK
- Cost considerations: The average cost of a divorce in the UK was £14,561 if acrimonious, fees can be much higher; the new law allows you to finalise the process in as little as 26 weeks with the court fees for a no-fault divorce being just £593
- Additional arrangements: You will still need to make arrangements regarding children and access rights, and decide how money, property, pensions or any other sources of income are to be divided
- Alternative approach: A top judge has said that a divorce should be viewed as a relationship problem, rather than a legal one, and encourages couples to resolve their differences out of court where possible
