Lasting Powers of Attorney

With Your Legal GP

A Lasting Power of Attorney (LPA) is a legal document known as a deed that enables you to appoint a family member, friend or professional the ability to make decisions about your health and welfare and/or property and finances in accordance with your wishes, preferences and instructions.

  • Health and Welfare LPA: A health and welfare LPA allows decisions relating to medical treatment, day to day social support that you may require and, decisions about where you will live. It can only come into effect when you lose capacity to make these decisions.
  • Property and Finance LPA: A property and finance LPA allows decisions to be made relating to matters such as day-to-day management of household bills, bank accounts, and benefits. It can also allow decisions relating any other property that you own. Your attorneys can help make these decisions for you whilst you still have capacity.

Why LPAs are Important

  • Future planning: Both LPAs are important as they give you the opportunity to plan in case you are not able to make decisions for yourself in the future: if you are unable to make decisions in the future your preferences and instructions will be followed by your nominated attorneys.
  • When LPAs end: An LPA will end if you decide to end it and have the mental capacity to make that decision; if your attorney dies or loses mental capacity and you do not have a replacement attorney; or if they disclaim from their duties and were acting jointly with another attorney.
