Land and Property Disputes

With Your Legal GP

Land and Property disputes typically relate to any dispute over land or property whether it be a residential or commercial setting. These disputes can be lengthy resulting in unnecessary costs. They arise in several situations, the most common being boundary disputes, adverse possession, rights of way and landlord and tenant disputes.

Common Types of Land and Property Disputes

  • Boundary Disputes: A boundary dispute is when there is a disagreement between two landowners or neighbours about the location of a boundary. The term boundary may refer to fences, walls, hedges or paths that divide the properties in dispute.
  • Adverse Possession: Adverse possession refers to the legal situation where a person takes the land of another without their permission. They can take the land from the legal landowner if they have been using the land for a long period of time.
  • Rights of Way: Rights of way occur when a person who does not own the land has a right of way over the land that has been established by use or necessity. They are often established over time and may not be put down in writing meaning that the landowner might not be aware of them.
  • Landlord and Tenant Disputes: Landlord and tenant disputes usually occur when either the tenant or landlord fails to uphold the terms of the tenancy agreement whether it be the tenant in rent arrears or the landlord failing to make necessary repairs to the property.

Land and Property disputes can be easily avoided by using mediation to resolve the dispute. Your Legal GP can help you solve your dispute in a cost-effective and amicable manner.
