Landlord and Tenant disputes are all too common and can occur in the form of rent arrears, breach of tenancy agreement or failure to carry out agreed repair works. A tenant who falls into rent arrears may be evicted, or a landlord that fails to carry out agreed repair works may be in breach of the tenancy agreement.

Common Dispute Types

  • Eviction procedures: If a landlord wants to evict their tenant they would need to apply for either a no-fault eviction or an eviction with grounds: A no-fault eviction is where you want your property back whereas an eviction with grounds is when your tenant falls into one of the 16 grounds for eviction such as being in serious arrears with their rent or have breached the terms in their tenancy agreement
  • Repair obligations: If a landlord is in breach of their tenancy agreement for failing to undertake repairs a tenant has remedies available to them to rectify the breach such as compensation or an order for the landlord to rectify the issue however landlords are now expected to make all reasonable attempts to resolve their issues with their tenants through impartial mediation services.
  • Tenant responsibilities: Equally there is an expectation on the tenant to pay their rent on time, not cause a nuisance to others and not damage the property beyond what would be considered normal wear and tear
  • Deposit protection: Tenants should also have their deposit held in a government approved tenancy deport protection scheme within 30 days of receiving the deposit; failure to do so will mean that the landlord may be liable to pay the tenant up to three times the value of the deposit
